I. Privacy Policy: The Data Architecture
1. Information Collection & Sources
Voluntary Data: Identifiers (name, email, phone) and commercial information (billing/shipping addresses, purchase history) collected via the ChromaRise Store.
Device & Behavioral Data: This is where the Meta Pixel and GA4 live. We collect IP addresses, browser types, and “Interaction Data”—which songs you played in the Lounge, which films you watched at the Studios, and which articles you read on HipHopInsiders.
Financial Data: Explicitly state that credit card info is processed by third-party encrypted gateways (e.g., Stripe, PayPal, or Shopify) and is not stored on ChromaRise servers.
2. The Use of “Cookies” and Tracking Technologies
Retargeting Disclosure: You must state that you use “First-party and Third-party cookies” to deliver targeted advertisements across the web.
Opt-Out: Provide a link to the Digital Advertising Alliance (DAA) or similar tools to give users the “Right to Opt-Out” of the tracking we’ve set up for DJ Nova and Kira.
3. International Compliance
GDPR (Europe): You must include the “Right to be Forgotten” (deletion) and “Right to Access” (data export).
CCPA (California): You must include a “Do Not Sell My Personal Information” disclosure.
II. Terms of Service: Protecting the “Cosmos”
This is the contract between you and the user. It protects your assets.
1. Intellectual Property (IP) Ownership
This is the most critical section for ChromaRise. You must state:
“All virtual personalities, including but not limited to DJ Nova, DJ Kira, and DJ Sole, are proprietary intellectual property. Their likeness, voice, and generated output are protected under copyright and trademark law.”
Users are granted a “Limited, non-exclusive license” to stream content for personal use, but they cannot redistribute or use it for commercial purposes.
2. E-Commerce & Merchandising Terms
Availability: You reserve the right to limit the sales of products or services to any person or geographic region.
Accuracy of Billing: Users must provide current and accurate info. You reserve the right to refuse or cancel orders that appear to be placed by dealers, resellers, or distributors.
Modifications: Prices for our products are subject to change without notice.
3. Limitation of Liability
This is your “Shield.” You must state that ChromaRise Media is not liable for any damages resulting from the use of your site, the inability to access the Chroma Lounge, or delays in shipping merchandise.
The “AS-IS” Clause: “Our services and products are provided ‘as is’ and ‘as available’ without any warranties of any kind.”
III. Refund & Shipping Policy (The E-Comm Pillar)
Essential for customer trust.
1. Shipping & Logistics
Processing Time: Specify that orders are processed within 3–5 business days.
International Shipping: Disclose that the customer is responsible for all customs, duties, and taxes (important for a global brand).
2. Return Policy
Physical Goods: 14-30 day window for unused/unworn items.
Digital Goods: Clearly state: “Due to the nature of digital downloads (music/film/art), all sales for digital content are final and non-refundable once the download or stream has commenced.”
